The list of foreign employees is a document that subcontractor must submit to their clients when entering into a contract, then every 6 months until the end of its execution.
It applies itself to all countries outside the European Economic Area (EEA) with some exceptions.
The following countries are not subject to work permit in France :
- The 27 members of European Union : Germany, Austria, Belgium, Bulgaria, Cyprus, Croatia, Denmark, Estonia, Finland, France, Spain, Greece, Hungary, Ireland, Italia, Lavtia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Czech Republic, Romania, Slovakia, Slovenia, Sweden ;
- The 4 countries of the European Free Trade Area (EFTA) : Iceland, Liechtenstein, Norway and Switzerland ;
- The countries with which France has concluded agreements : Monaco, Andorra, Saint-Martin.
The case of United Kingdom
It is important to nota that as of February 1, 2020 the UK is no longer a member of the EU. However, a transition period has been put in place from that date until 31 December 2020 during which despite the Brexit, the United Kingdom remained a member of EEA. As of January 1, 2021, the transition period has ended and the United Kingdom is no longer in the EEA. British citizens are therefore now covered by the list of foreign employees subjectif to work permits and must have a valid residence permit.
